Abstract

The present global efforts of privatization and deverticalization have brought, in the last few years, changes to the structure of the state-owned electric industry of Brazil, including the up-bringing of new agents and of a new regulatory framework. The electric industry has been the field for the breaking-up of state-owned giants into segments for generation, transmission and distribution and also for the up-bringing of companies devoted exclusively to electric energy commercialization. The new agents, specially ANEEL, the "Agência Nacional de Energia Elétrica", are the cause of profound changes in the daily life of companies and people. These changes aim at increasing the quality of electric services through incentive to competition and tighter fiscalization on the enforcement of the new regulation. But the subject of universalization of electrical services, particularly in rural areas, has not even been considered in the initial years of the Brazilian electric industry restructuration. Only by the of year 2000 has ANEEL started public discussion of new legislation intending to put an end to the lack of electric service to millions of people located in remote isolated areas of Brazil. Along with this action of the Executive Power, the Legislative Power has also started self-motivated action. As a result Law 10.496 has been approved, in April 2002, to set new objectives for the effort of electric service universalization in Brazil. The present paper analyses the Law and forwards suggestions to help ANEEL in their job of regulamentation of the subject.
