This article intends to aboard the actuation of Brazilian black movements, in the decades of 1990 and 2000, for access to public Higher Education. In consequence of the straight of these demands, recent Brazilian governments (1995 - 2002 and 2003 - 2010) chose to insert intellectuals and leaders from these movements in government structures so they could work on the formation and execution of group-oriented social policies. Based on official documents and literature, we suggest a reflection on the kind of State policies elaborated between 1990 and 2000 to attend demands for higher education, being quotas for ingress in public universities the most common form of claiming of the black movements. Affirmative Actions in Public Higher Education were discussed for throughout society - political and civil - and the debate was polarized between pro and con. In consequence of established disputes in the three instances of power (executive, legislative and judicial), we conclude that the creation of space inside State structures aloud the emergence of a public debate about educational conditions for blacks in Brazil, as well as projects and policies in areas such as health, religiousness, among others, that are currently in process. Contrary to previous context in which the false idea of racial democracy and the maintenance of order hid social inequality enhanced by racial discrimination.
