The Youth and Adult Education (EJA) is a genre of basic education designed to school inclusion of those who have been denied the right to a regular education at the proper age, being, thus, "marginalized and excluded from the benefits of achievements economics, political, social and cultural." (ROMÃO; GADOTTI, 2077, p.9). In 2011, the National Fund of Education (FNE) provided didactic material for the State System of Education of São Paulo to the YAE students, with the aim to offer teachers and students a better support in the classroom. Recent theme and an extreme importance also in the educational scope is the law 10.639, sanctioned in 2003 by the President of Republic, that changes the GBL (Law of Guidelines and Bases, 1996) establishes that is mandatory in elementary and in high school, public and particular, the teaching of History and Culture African and Afro-Brazilian. It is a legislation that opens the way for the dissemination of the African culture - which has strong representativeness in our society - at the schools, in which classrooms there´s very little or no approach to the subject. The aim of this study is to discuss the presence and effectiveness of the law in the didactic material of the State System of Education of São Paulo to the YAE students (Youth and Adult Education), more specifically we search to analyze the contents in the Literature and History subjects in the context of the guidelines proposed by the legislation involved.
